This site is owned and operated by The Bicycle Association of Great Britain Limited, the ‘BA’ or ‘we’ or ‘our’ or ‘us’.

By using any area of this site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use this site.

This site’s Privacy Policy and Cookie Policy and, where applicable (if you are a trade association member of the BA), Member Terms also apply to your use of this site.

We may amend these terms from time to time. Every time you wish to use this site, please check these terms to ensure you understand the terms that apply at that time.

Material and content on the site

We are the owner or the licensee of all intellectual property rights in our site and the material published on it.  Such intellectual property rights and material are protected by international copyright and trademark laws and treaties.  All such rights are reserved.

Unless expressly stated or agreed by the BA otherwise in writing, you may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any way, any material from this site including code and software. 

You may download material from this site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

We may update and change our site from time to time and we do not guarantee that this site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

Disclaimers and limitation of liability

Where the BA has provided links and pointers to Internet sites maintained by third parties, such links should not be interpreted as approval by us of those linked websites or the information you may obtain from them.  Unless we advise otherwise, the BA does not operate or control, in any respect, any information, products or services on these third-party sites. 

Unless expressly stated or agreed by the BA otherwise in writing, the materials in this site and the third-party sites are provided “as is” and without warranties of any kind either express or implied. 

Unless expressly stated or agreed by the BA otherwise in writing, to the fullest extent permissible pursuant to applicable law, the BA disclaims and excludes all warranties, express or implied, including, but not limited to, any applicable implied warranties of merchantability and fitness for a particular purpose. 

The BA does not warrant or guarantee that the site or the functions contained in the materials on the site will be uninterrupted or error-free, that defects will be corrected, or that this site, or the server that makes it available, are free of viruses, bugs or other harmful components.  You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

The BA does not warrant or make any representations regarding the use or the results of the use of the materials in this site or in third-party sites in terms of their correctness, accuracy, timeliness, reliability, or otherwise. 

To the fullest extent permissible pursuant to applicable law, and unless expressly stated or agreed by the BA otherwise in writing, under no circumstances, including, but not limited to, in contract, tort (including negligence), breach of statutory duty, or otherwise shall the BA be liable for any direct, indirect, incidental, special or consequential damages or losses that result from or in connection with the use of, reliance on or the inability to use, this site or the materials on this site (regardless of whether any such damage or loss was foreseeable). 

In particular, we will not be liable for any: loss of profits, sales, business, or revenue; loss of data, business interruption; loss of anticipated savings; or loss of business opportunity, goodwill or reputation (regardless of whether any such loss was foreseeable).

If you are dissatisfied with the site, any BA material, or with any of the BA’s terms and conditions, unless expressly stated or agreed by the BA otherwise in writing, your sole and exclusive remedy is to discontinue using the BA website.

Security

If you choose, or you are provided with, a user identification name, code, password or any other piece of information as part of our security procedures, you must treat and keep such information as confidential. You must not disclose it to any third party.

You must not misuse our site by knowingly transmitting, sending or uploading any data or material that contains or otherwise introduce any viruses, trojan horses, worms, logic bombs, time bombs, keystroke loggers, spyware or other material or program or code that is malicious or technologically harmful or which is designed to adversely affect the operation of any computer software or hardware. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

User Content and Community Groups and Forums

Our site may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. 

Whenever you make use of a feature that allows you to create content directly on our site, upload or share content to our site, or to make contact with other users of our site, you must comply with the standards set out below.

You warrant that any such contribution complies with such standards, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

We will consider any content you upload to our site to be non-confidential. 

You warrant that you own such content or are otherwise licensed to upload the content.  You hereby grant us a licence to use, store and copy such content and to distribute and make it available to others. 

We have the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to our site violates their intellectual property rights or their right to privacy.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the standards set out below.

Standards

These standards apply to any material you upload or share to our site or generate on our site (User Content). They also apply to any contact you make with other users on our site, links to our site, and any other ways you use our site.

We will determine, in our sole discretion, whether any User Content or your use of our site breaches these standards.

You may not use our site:

• In any way that breaches any local, national or international law or regulation.

• In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

• For the purpose of harming or attempting to harm minors in any way.

• To bully, insult, abuse, intimidate or humiliate any person.

• To send, knowingly receive, upload, download, share, post, use or re-use any material which         does not comply with our standards.

• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation.

User Content must: (i) be accurate (where it states facts), (ii) only contain opinions that are genuinely held, and (iii) comply with applicable law.

User Content must not: (i) be defamatory of any person, obscene, offensive, indecent, hateful, discriminatory or inflammatory, (ii) infringe any copyright, database right or trade mark or privacy right of any other person, (iii) be likely to deceive any person, (iv) breach any legal duty owed to a third party, (v) contain illegal content or promote any illegal content or activity, (vi) impersonate any person or misrepresent your identity or affiliation with any person, (vii) be pornographic.

BA’s Market Data Service (MDS)

In the event that you are provided with or otherwise access any MDS report, results and/or information through or via any area of this site, you hereby agree and acknowledge that all intellectual property rights in the MDS and such report, results and/or information are owned by the BA, and that you may only use the MDS and such report, results and/or information for internal use to undertake market analysis and agree not to amend or share publicly or publish outside of your organisation any such report, results and/or information, save with the prior written consent of the BA.

Other

These terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law.  You and the BA both agree to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the terms and shall not affect the validity and enforceability of any remaining provisions.
